1. Acceptance of Terms
These Terms & Conditions ("Terms") form a legally binding agreement between you and Arogya Prana ("Company", "we", "us") governing your access to and use of the Arogya Prana Platform, including all associated websites, web applications, and services (collectively, the "Platform").
These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019.
2. Eligibility
You may use the Platform only if:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding contract under Indian law
- You are not prohibited from using the Platform under any applicable law or regulation
- All information you provide during registration is accurate, current, and complete
Healthcare professionals registering as doctors must hold a valid registration with the National Medical Commission (NMC), a State Medical Council, a Dental Council, or an equivalent recognised regulatory body in India. Providing false credentials is a violation of these Terms and may be reported to the relevant regulatory authority.
Institutions registering as hospitals must be duly registered under applicable Indian law (e.g., Clinical Establishments (Registration and Regulation) Act, 2010, or equivalent state legislation).
3. Account Registration and Security
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorised use of your account
- You may not share your login credentials with any third party or allow others to access your account
- We reserve the right to suspend or terminate accounts where we reasonably suspect unauthorised access, fraud, or a breach of these Terms
- Each person may hold only one account. Creating multiple accounts to circumvent restrictions or moderation decisions is prohibited
4. Healthcare Professional Obligations
If you register as a doctor on the Platform, you agree to:
- Provide accurate and up-to-date information about your qualifications, registration, and practice
- Comply with all applicable laws and ethical guidelines of your regulatory body, including the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002, or equivalent dental/ayurveda/homeopathy regulations
- Not use your profile for any purpose that violates the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954
- Not solicit patients or make unsubstantiated claims about treatment outcomes
- Promptly update your profile if your registration status, address, or credentials change
- Comply with our content moderation decisions regarding health articles you publish
Public visibility is subject to approval. Registering and paying for a plan does not guarantee that your profile will be published. Profiles are reviewed for accuracy and compliance before receiving public visibility.
5. Hospital Account Obligations
If you register as a hospital, you agree to:
- Provide accurate registration, address, and contact details for your institution
- Ensure that any affiliated doctors listed on your profile have consented to the affiliation
- Not display doctor affiliations unless the doctor is also a registered user on the Platform (affiliations require mutual active paid plans to be displayed publicly)
- Comply with Clinical Establishment rules applicable in your state
- Promptly notify us of any changes to your operational status, ownership, or accreditation
6. Content Guidelines
When you submit content to the Platform (including health articles, profile descriptions, reviews, and messages), you agree that such content:
- Is accurate, truthful, and not misleading
- Does not infringe any third-party intellectual property rights
- Does not contain defamatory, obscene, or offensive material
- Does not constitute medical advice intended to substitute professional in-person consultation
- Complies with the National Medical Commission guidelines on healthcare advertising
- Does not include any promotional claims that are prohibited under applicable Indian law
All health articles are subject to editorial moderation before publication. We reserve the right to refuse, edit, or remove any content that violates these guidelines, without prior notice.
By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your content as part of the Platform's operation.
7. Subscription Plans and Payment
- Subscription plans are billed on a yearly basis as described on the Pricing page
- All prices displayed are exclusive of applicable taxes. Goods and Services Tax (GST) at the prevailing rate will be charged additionally at the time of checkout
- Payment is processed securely through our payment processor; we do not store your payment card details
- Subscriptions auto-renew unless cancelled at least 7 days before the renewal date
- Refunds are governed by our Refund Policy. In general, subscriptions are non-refundable after the profile has been reviewed and activated, except as required by applicable Indian consumer protection law
- We reserve the right to modify pricing upon 30 days' prior notice. Continued use after the notice period constitutes acceptance of the revised pricing
8. Intellectual Property
All content on the Platform other than user-submitted content — including but not limited to the Arogya Prana brand, logo, software, interface design, and data compilations — is owned by or licensed to Arogya Prana and is protected under Indian intellectual property law.
You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.
9. Healthcare Disclaimer
The Arogya Prana Platform is an information directory, not a medical service.
- Content on the Platform — including doctor profiles, hospital information, and health articles — is provided for general informational purposes only
- Nothing on the Platform constitutes or should be treated as medical advice, diagnosis, or treatment
- The Platform does not facilitate teleconsultation or the prescribing of medication
- In a medical emergency, call 112 (India's national emergency number) or go immediately to the nearest hospital emergency department
- Listing a doctor or hospital on the Platform is not an endorsement of their clinical judgment, treatment methods, or outcomes
- Patients should always consult a qualified, registered healthcare professional for individual medical advice
We expressly disclaim all liability arising from reliance on any content on the Platform as a substitute for professional medical advice.
10. Limitation of Liability
To the fullest extent permitted by applicable Indian law:
- We are not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform
- Our total aggregate liability to you for any claim arising under these Terms shall not exceed the subscription fees paid by you in the 12 months preceding the claim
- We are not responsible for the accuracy of user-submitted content, including professional credentials; we take reasonable steps to verify credentials but do not guarantee their accuracy
- We are not liable for any interruption, suspension, or termination of the Platform beyond our reasonable control
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable Indian law.
11. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable Indian law
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Submit false or misleading professional credentials
- Attempt to gain unauthorised access to any part of the Platform or its infrastructure
- Use automated tools (bots, scrapers) to access or collect data from the Platform without our written permission
- Interfere with or disrupt the Platform, its servers, or networks
- Post spam, unsolicited commercial communications, or malicious content
12. Termination
We may suspend or terminate your account and access to the Platform, with or without notice, if we determine (in our sole discretion) that:
- You have breached any provision of these Terms
- You have provided false or misleading information
- Continued access poses a risk to the Platform, its users, or third parties
- Required by applicable law or a court order
You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will continue to apply.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [City], India (to be updated with the registered office location).
14. Dispute Resolution
Before initiating formal legal proceedings, you agree to attempt to resolve any dispute with us informally by contacting us at support@arogyaprana.com and allowing us 30 days to address your concern.
If informal resolution fails, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996. Both parties agree to accept the arbitral award as final and binding.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to you by:
- A notice on the Platform at least 15 days before the new Terms take effect
- An email notification to your registered email address
Continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree, you must stop using the Platform and may close your account.
16. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable Indian law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.
