Terms and Conditions for Doctors

Terms governing doctor applications and verified doctor listings.

1. Agreement

These Terms and Conditions ("Doctor Terms") govern your application for, and use of, a doctor listing on Arogya Prana ("we", "us", "the platform"). They are an electronic record under the Information Technology Act, 2000.

By submitting a doctor application, and by continuing to hold a listing, you agree to these Doctor Terms and to our Privacy Policy. You must accept the current published version before your application can be submitted.

These Doctor Terms apply in addition to the User Terms. Where they conflict on a matter concerning your listing, these Doctor Terms prevail.

2. Eligibility and registration

You confirm, and must continue to be able to confirm, that:

  • You are an individual medical practitioner registered with the National Medical Commission or a State Medical Council (or the corresponding statutory council for your recognised system of medicine), and your registration is current and in good standing;
  • Your registration is not suspended, cancelled, or subject to pending disciplinary proceedings that would affect your right to practise;
  • The qualifications, specialties, experience, and practice locations you submit are true, complete, and your own; and
  • You are legally competent to contract and are applying on your own behalf, not on behalf of another practitioner.

You must notify us within 7 days if any of the above ceases to be true. Continuing to hold a listing while unregistered or suspended is a material breach.

3. Verification

  • We review your submitted evidence and may verify your details against publicly available council registers and other lawful sources.
  • Verification is at our discretion. We may approve, request more information, or decline an application, and we will tell you the reason for a decline.
  • Verification confirms review of the evidence at a point in time. It is not a warranty by us of your competence, and it does not create any professional relationship between us.
  • We may re-verify periodically, and may suspend a listing pending re-verification if credentials appear lapsed or disputed.
  • Supporting documents you upload are held in private, access-controlled storage and are not published. Identity and credential fields necessary to the listing — such as your name, qualifications, specialties, and practice locations — are published, and that is the purpose of the listing.

4. Your professional and legal responsibilities

You remain solely and independently responsible for your clinical practice. Specifically:

  • We are not your employer, partner, agent, or supervisor, and we do not direct, review, or take responsibility for your clinical decisions.
  • You must comply with the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002 and any applicable National Medical Commission professional conduct regulations in force, the Telemedicine Practice Guidelines, 2020 where you consult remotely, and all other laws applicable to your practice.
  • You are responsible for your own professional indemnity insurance. We strongly recommend you maintain adequate cover. We provide none.
  • You are responsible for your own clinical records, consents, and the privacy of your patients. For any patient record you create, you are an independent Data Fiduciary under the Digital Personal Data Protection Act, 2023; we are not.
  • You must handle enquiries you receive through the platform lawfully, use the contact details only to respond to that enquiry, and not add enquirers to marketing lists without their consent.

5. Profile and article content

You are responsible for the accuracy of everything on your profile, including qualifications, services, timings, and fees, and must keep it current.

Content you publish, including health articles, must:

  • be accurate, evidence-based, and within your area of competence;
  • not solicit patients, or advertise in a manner prohibited by applicable medical council professional conduct regulations, including self-laudatory claims, guarantees of cure, or comparative claims about other practitioners;
  • not guarantee any outcome, cure, or success rate;
  • comply with the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954;
  • not advertise or offer prenatal sex determination, which is prohibited by the Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994;
  • not promote the sale of prescription medicines or unapproved treatments;
  • not misuse patient information or images — you must hold documented consent for any patient image, testimonial, or case detail you publish, and it must be de-identified unless you hold specific consent; and
  • not infringe anyone's copyright or trade marks.

Where you use platform tools that draft content with AI assistance, you remain the author of record. You must review, correct, and approve the content before publication, and you are responsible for it. We may require editorial review before publication.

You grant us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, adapt for formatting, and distribute your profile and published content on and in connection with the platform, including in search results and previews, for as long as it remains published.

6. Prohibited arrangements

You must not, through or in connection with the platform:

  • pay, offer, receive, or solicit any commission, referral fee, kickback, or fee-split for patient referrals, which is prohibited under applicable medical council professional conduct regulations;
  • post, solicit, incentivise, or pay for fake or manipulated reviews, or offer anything of value in exchange for a review;
  • attempt to manipulate search ranking by deceptive means; or
  • create duplicate or misleading listings.

Breach of this Section is a material breach and may result in immediate suspension and removal of your listing.

7. Subscription, fees, and taxes

  • Paid listing plans, their features, and prices are shown at the point of purchase. Plans are billed on the cycle stated at purchase, and applicable Goods and Services Tax is charged in addition unless stated to be inclusive.
  • We issue a GST-compliant tax invoice for each payment.
  • Payments are processed by a third-party payment gateway; we do not store your card or banking credentials.
  • A payment purchases access for the billing period shown at checkout. It does not renew automatically unless the checkout clearly identifies a recurring payment and you separately authorise the required mandate.
  • You may cancel a future renewal through the available account control or by contacting support. Cancellation stops future renewal and normally leaves paid access available until the end of the current billing period.
  • A refund may be available where the same payment was captured more than once; payment was captured but the purchased service could not be activated because of our error; an unauthorised transaction is confirmed by the payment provider or applicable law; the checkout expressly granted a refund right that applies; or applicable Indian law requires a refund.
  • Once a paid plan has been activated, a change of mind, lack of use, rejection or suspension caused by false information, or breach of these Doctor Terms does not automatically create a refund right. This does not limit any statutory remedy that cannot lawfully be excluded.
  • Request a billing review promptly, preferably within 7 calendar days after discovering the issue, by emailing support@arogyaprana.com with the payment identifier, account email, reason, and necessary supporting details. This request period does not shorten a longer right provided by applicable law. Never send card numbers, banking passwords, PINs, or one-time passwords.
  • Approved refunds are returned through the original payment method where reasonably possible. Payment-provider and bank processing times are outside our control. Applicable invoices, credit notes, coupons, and plan access will be adjusted consistently with the outcome.
  • If a payment fails or a subscription lapses, paid features may be downgraded or suspended after notice. Your verified status is not itself revoked for non-payment, but paid placement and premium features are.
  • We may change prices on reasonable prior notice, effective from your next renewal. You may cancel before renewal if you do not accept the change.

8. Reviews of you

Patients may review you. Reviews are the reviewer's own opinion and we do not adopt them. We moderate against our content standards, and you may report a review that you believe is fake, defamatory, or discloses confidential information. You must not respond to a review in a way that discloses a patient's identity, attendance, or clinical information — professional confidentiality obligations continue to apply online.

We do not remove reviews merely because they are unfavourable.

9. Suspension and removal

We may suspend or remove your listing if:

  • your registration lapses, is suspended, or is cancelled;
  • your submitted information is found to be false or materially misleading;
  • you materially breach these Doctor Terms;
  • a regulator, court, or council directs us to; or
  • it is necessary to protect patient safety.

Except where immediate action is necessary for safety or required by law, we will give you notice, the reason, and a fair opportunity to respond. You may appeal to our Grievance Officer.

On termination we retain your application and verification records for the period stated in our Privacy Policy, so that we can evidence our verification decisions.

10. Disclaimers and liability

To the maximum extent permitted by Indian law:

  • The platform is provided "as is". We do not warrant any level of enquiries, patients, visibility, ranking, or revenue.
  • We are not liable for indirect, incidental, special, consequential, or punitive loss, or loss of profits, goodwill, or reputation.
  • Our total aggregate liability arising out of or relating to your listing is limited to the total subscription fees you paid us in the twelve months before the claim, or ₹1,000 if you have paid nothing.
  • Nothing excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by our negligence.

11. Indemnity

You will indemnify us against claims, losses, and reasonable legal costs arising from: your clinical practice; any care you provide or fail to provide; the accuracy of your credentials and profile; your published content; your breach of these Doctor Terms; or your breach of patient confidentiality or data protection law. This does not apply to the extent the claim arises from our own breach or negligence.

12. Privacy, consent, and advertising

Our handling of your personal data is governed by our Privacy Policy.

Account security. You are responsible for keeping your credentials confidential and for all activity under your account. If you know or suspect that your account has been accessed without your permission, or that your credentials have been lost or exposed, tell us immediately through the contact route in Section 15. Because your listing can receive patient enquiries, prompt notice matters. We may suspend access, force a credential reset, or require re-verification to protect users and your listing, and will tell you when we do. You remain responsible for activity under your account until you report the compromise, except where the unauthorised access resulted from our own failure.

Third-party links. Your profile, and any advertisement you may place, can link to your own website or booking system. Those destinations are yours, are governed by your own terms and privacy policy, and are your responsibility. A link from the platform is not an endorsement by us.

Advertising. We do not currently serve advertising or accept sponsorship. If we introduce either, it is governed by our Advertising and Sponsorship Policy, and any participation by you as an advertiser or sponsor is subject to that policy as well as these Doctor Terms.

Personalised advertising to platform users will require the user's separate, specific, opt-in consent, given through a distinct control that is off by default. That consent is not part of these Doctor Terms and is never a condition of holding or maintaining a listing.

Any paid or sponsored placement product we may offer will be a separate, optional commercial agreement, will be clearly labelled as advertising or sponsored at the point of display, and will be visually distinguished from organic search results.

Payment does not affect verification, moderation, or organic ranking. Buying a placement cannot obtain, accelerate, or preserve your verified status, cannot influence how we moderate reviews or content about you, and cannot improve your position in organic search results. Verification is decided only on the evidence you submit. If you are independently verified, you may continue to display your verification badge, but an advertisement must not present that badge as a paid endorsement or imply that we recommend you. Advertising content remains subject to the professional conduct and claim restrictions in Sections 5 and 6.

13. Governing law and disputes

These Doctor Terms are governed by the laws of India, and the courts at Guntur, Andhra Pradesh, India, have exclusive jurisdiction, subject to any mandatory forum provided by law. Please raise any complaint with our Grievance Officer first; we will handle it within the statutory timeline applicable to its subject.

14. Changes to these Terms

These Doctor Terms are version-controlled, and every published version is retained as an immutable record with its effective date. When we publish a materially changed version, we will notify you, and where the change requires it you will be asked to review and accept the new version before you can continue to use listing management features.
